Vapors in NY need to contact their Senators and Assembly members and tell them to vote NO on A9529!

A9529 - NY Senate Open Legislation - Rosenthal (MS) - Prohibits the sale of electronic cigarettes to minors and items not defined as a tobacco product or approved by the FDA as a tobacco use cessation or harm reduction - New York State Senate

OMG!!! They're counting on people reading the first 8 words and passing it. Damn good marketing tactic but OMG!!! This could bring the United states vaping community to their knees. New York Residents and anyone who has family or friends in New York. Please contact those people residing in that state and ask them to do exactly what is needed to have this bill changed. Prohibit minors from any use of nicotine but not the adults.

SUMMARY OF SPECIFIC PROVISIONS: The bill would amend the Public Health
Law by amending Section 1399-cc to include electronic cigarettes in each
subsection and defining an electronic cigarette in subsection (d).

The bill would also amend the Public Health Law by adding a new Section
1399-mm-1. The section provides that products containing or delivering
nicotine and intended for human consumption shall not be distributed or
sold unless the FDA has given approval. The section further provides
that the attorney general may issue an order compelling compliance with
this provision and further grants the court the ability to impose a
civil penalty for violations of this law.

That is heavy duty!

Received this today:

Dear Mr. Walker:

This is in response to your email regarding Assembly Bill A9529 which prohibits the sale of electronic cigarettes to minors; prohibits distribution or sale of any item containing or delivering nicotine that is not defined by law as a tobacco product or approved by the United States food and drug administration for sale as a tobacco use cessation or harm reduction product.

This piece of legislation does not currently have a Senate sponsor. It was reffered to codes on 2/23/10. Should this bill come to the floor of the Assembly for a full vote I will be voting against it.

If either my staff or I can be of further assistance, please do not hesitate to contact us at 845-463-1635 or via email at millerj@assembmly.state.ny.us.

Thank you again for writing.

Sincerely,

Joel M. Miller
Member of Assembly
102nd Assembly District

JMM/nmk

Look like we have someone on our side!

LeCig,
Further down in the bill they want to make amendments to the public health law, and add an outright ban of electronic cigarettes. They just worded the title as a "Protect the Children" bill.

Just start reading the bill it's definately is using the prohibition of minors as a marketing tool. If you read on you'll see the alternate motives accompanying it.
